图书馆“馆藏著作从属性原则”研究--以《欧盟信息社会著作权指令》视域下《德国著作权法》为考察对象

There are still no regulations concerning the property principle of works in Chinese library collection. Under the framework of Copyright Directive of the European Union Information Society, the German Copyright Law stipulates explicitly the property principle for German libraries. This paper analyzes the opinions and suggestions on the electronic materials housed at libraries of EU institutions, illustrates the legislative purposes, elements and feasibilities of the“property principle of works in library collection” in German Copyright Law, and provides an outlook of the application of the principle in China. The principle is of great significance for Chinese libraries, which indicates that libraries in China should take two restrictive measures to avoid copyright infringement: the number of simultaneous online readers of one electronic book must not exceed the number of its printed copies; part or all of the content of one book are not allowed to download, photocopy, print, email, etc.%在图书馆“馆藏著作从属性原则”方面，我国立法规定付之阙如。在《欧盟信息社会著作权指令》框架下，《德国著作权法》对该原则进行明确规定。文章分析欧盟相关机构针对《指令》所规定的图书馆对馆藏著作电子化复制行为的意见与建议，阐释《德国著作权法》中“馆藏著作从属性原则”相关规定的立法目的、构成要件、可行性分析，展望“馆藏著作从属性原则”在我国的适用。该原则对我国的借鉴意义在于，为避免著作权受到非法侵害，图书馆应采取双重限制措施：馆藏著作电子版的同时在线阅览人数不得超过该著作纸质版的复本量；读者不得通过下载、复制、打印、发送电子邮件或其他技术手段对该著作的部分或全部内容进行重新制作。
