我国刑事强制措施的完善——确立司法审查制度

摘要

刑事强制措施是一个国家的民主与法治程度的重要度量器。我国的刑事强制措施在实践中存在越权行使权力,犯罪嫌疑人、被告人权利保障不够或侵害涉讼公民的合法权益等缺陷。为了适应社会转型时期的客观需要,有必要进一步对其进行完善或重构。完善我国的刑事强制措施既有利于追究犯罪,又有利于保障人权。%Criminal compulsory measures are the important measure of control to a country＇s level of democracy and the rule of law.There are some shortcomings in China＇s system of criminal compulsory measures,which need to be improved to adapt to the objective needs of social transition.To improve China＇s criminal compulsory measures will not only promote the effective action,running smoothly and timely investigate and punish crime,but also help safeguard the citizen＇s human rights.
