随着社会风险的不断渗透，社会结构的转型已成必然之势，在此背景之下，宽严相济刑事政策的适用就被赋予了风险防控的意义。但是，刑事政策并非应对社会风险的唯一机制，其职能展开尚需其他社会调控措施的配合，故而，只有明确了刑事政策在风险防控中处于怎样的位置，才能够理顺其职能发挥的方式，进而实现其对风险调控的效果。对于“宽严相济”刑事政策的考察，并不仅仅是为了掌握其在风险社会中的价值存在，更是以此为主线理解整个社会调控措施在风险转型时期的运作方式，以明确风险控制机制的升阶方向。%Along with the penetration of social risks , the transformation of social structure has become an in-evitable trend .In this context , the application of “justice tempered with mercy” criminal policy is endowed with the meaning of risk prevention and control .Criminal policy is not the only mechanism of social risks , its function expansion is needed with other social control measures .A clear positioning of the criminal policy in the risk prevention and control can straighten out its function and achieve risk controlling .The study on“justice tempered with mercy” criminal policy can grasp its value in risk society , and take this as the main line to understand the operation mode of whole social control measures during its transitional period , in order to make the development direction of risk control mechanism clear .
