浅析我国新刑事诉讼法对监视居住制度的修改

摘要

由于监视居住措施一直以来备受争议，刑事诉讼法的修改针对在实践中存在的突出问题进行了重大的调整，基本上是重塑了监视居住制度。然而实行一年以来仍存在一些问题，为此必须进一步完善立法，充分发挥监视居住的作用，保证诉讼的顺利进行，减少羁押，降低诉讼成本。%As residential surveillance has always been a controversal issue, the amendment to Criminal Procedure Law made a significant adjustment to major problems of residential surveillance in practice; in other words, it basically reshaped the residential surveillance system. However, there are still some problems since its implement one year ago. Therefore, the law should be improved further and the roles of residential surveillance should be fully played to ensure the smooth proceedings and reduce detention and litigation cost.
