基于制度视角的食品安全“善治”模式探讨

         

摘要

食品安全是关系国计民生的一个极为突出的问题,由于食品安全具有的信息不对称、食品安全的公共产品特性与外部性属性,使现有的食品安全治理模式呈现出“市场失灵”和“政府失灵”的双重特点。仅依靠政府或市场某一个主体来治理食品安全,并不能有效消除食品安全隐患。食品安全治理机制的构建本身作为一种制度安排,离不开政府、社会中间组织和市场三方的协调与合作。研究发现更为现实的选择是从社会中间组织的角度,寻求促使这些组织之间协调合作、共同治理的制度安排,以实现食品安全的“善治”。从而实现食品产业健康可持续发展,增进公共利益,化解我国社会矛盾、推动社会转型、推进法制建设具有重大的现实意义。%Food safety is a very prominent problem of people's livelihood and it includes both the quantity and the quality of safe food supply. By analyzing the defect of the existing food safety governance, it is found that because of the asymmetric information of food safety and its product features and external public property, the existing food safety governance model shows a dual characteristic of "market failure"and"government failure". Based on the analysis of the failure of market mechanism and government supervision of food safety , the paper concludes that only relying on a particular subject of the market or the government to govern food safety can not effectively eliminate food safety hazards. It is necessary to find the effective solutions from the perspective of social intermediary organizations. As a kind of institutional arrangement, the construction of food safety governance mechanisms requires the coordination and cooperation of government, social intermediary organizations and markets. The research shows that a more realistic option is to seek the institutional arrangement of food security governance which can promote the coordination among those organizations and finally achieves the "good governance"on food security, healthy and continuous development of food industry and the enhancement of the public interest. It has a great practical significance in resolving social conflicts, pushing forward social transformation and the legal system building.
