从法治国家到法治社会：现代大学制度的反思与重构

摘要

With the gradual promotion and deepening of higher educational reform,the construction of mod-ern university system has been formally on the agenda.The modern university system construction is closely re-lated to the rule of law.At present,the construction of modern university system in China has some problems, including deficiency of the conceptual aspects,imperfection of the system and deviation of the implementation, etc.From the perspective of a state based on the rule of law,the reasons lay mainly to too much concentration on political life of the theme,the single main body and the manifest state standard,etc.In order to promote and perfect the construction of modern university system,under the vision of a society based on the rule of law,we should strengthen the system construction,promote the joint governance of state and society and cultivate the so-cial public rationality continually.%随着高等教育体制改革的逐步推进和深化，现代大学制度已正式被提上建设议程。现代大学制度建设与法治建设密切相关。目前我国现代大学制度建设存在理念层面的缺失性、制度层面的不完整性和行动层面的偏差性等问题。从法治国家角度看，原因主要在于主题过于集中政治生活、主体较为单一以及国家本位过于彰显等。为了进一步推进和完善现代大学制度建设，在法治社会的视域下，应该不断加强制度建设、推进国家和大学共治以及培育社会公共理性。
