与单独犯罪相比较而言,共同犯罪的犯罪构成具有相似性,其构成要件要素也是层次排列,但在满足成立犯罪的程度方面,单独犯罪比共同犯罪多一个层次的要件--责任性.在构成共同犯罪的实质层面,意思联络的有效性被认为是各行为人的主观内容.片面、误解以及虚假的意思联络被排除在共同犯罪主观认识之外.%Compared with independent crime,joint crime is similar,considering its hierarchical ranking of elements of constitution.However,in terms of the extent of setting up the crime,the layers of independent crime is much more than joint crime by one accuntability.At the substantive level of setting up joint crime,validity of the means of communication is regarded as the subjective content.One-sided meaning contact、false meaning contact、misunderstanding meaning contact are excluded from the subjective cognizance.
