反思交通违法非现场执法中累积记分的应用

摘要

累积记分制度是规范驾驶人合法驾驶的有效方法，其应当属于交通管理部门行政处罚的一种。作为对违法驾驶行为处罚的记分具有强烈的人身属性，不能够应用于非现场执法模式下的行政处罚中。现行制度下累计记分制度在非现场处罚中的应用方是驾照买分卖分现象的根源所在。为解决买分卖分的乱象、切实保护公民权利，应将记分排除出非现场执法。建立人、车分别管理的模式是我国道路交通安全管理的一个发展方向。%The system of accumulative scor ing is an effective method for the legitimate drivers, and it can be considered as a kind of administrative penalty in the traffic management. With a personal attribute, the accumulative scoring can not be used by the illegal off-site enforcement. It is an underlying reason that why license-points can be traded in the market in recent years. To eliminate this deviant trade and protect civil rights, we must exclude the accumulative scoring in off-site enforcement. It is a trend for the roan traffic security management to establish a mode to manage driver and vehicle differently.
