论我国现代化转型期农村留守儿童的权利保护

摘要

Protection of left-behind children’s rights has become a major problem in society.And there are three types of such problem: lack of paternal care,lack of right to education and lack of safety.The root of the problem is mainly the collapse of the protection system in traditional society,which is probably caused by the first and the second modernization. The two modernizations can not effectively make clear of social risks.To solve the problem,it is necessary to focus on the establishment and improvement of a dual-track system-left-behind children’s social protection system and family care system which can reinforce the fundamental function of family in children‘s rights protection.%农村留守儿童权利保护已经成为重大社会问题。亲权、受教育权以及安全权益的保护不足构成留守儿童权利缺失的三种主要类型。农村留守儿童权利保护羸弱的根源在于两次现代化转型使传统社会保护体系遭到破坏，无法有效隔离社会风险。强化农村留守儿童保护必须走“双轨制”道路：一方面，国家应当建立健全农村留守儿童的社会保障制度；另一方面，国家应当系统构建保护家庭的服务体系，重塑家庭保障在农村留守儿童权利保护体系中的基础性功能。
