The development of Internet technology has promoted the transformation in all walks of life. Traditional business gradually evolved into e-commerce.The legislation on e-commerce in China still needs to be improved. There are some problems in the collection, identification and preservation of electronic evidence during e-commerce transactions. In order to safeguard consumers rights and build online dispute resolution mechanism for e-commerce transactions, it is necessary to establish an online notarization platform, improve the electronic signature system and create a third-party electronic evidence collection and identification system. The authenticity and legitimacy of electronic evidence can guarantee the development of e-commerce.%互联网技术的发展推动着社会各行各业的变革,传统商务逐渐演变为电子商务,我国有关电子商务的立法虽有进展却不尽完善,电子证据在解决电子商务纠纷时在收集、认定与保全方面等方面均存在一定的问题,为了维护电子商务交易中消费者的合法权益,同时构建电子商务交易的网上纠纷解决机制,可以通过建立网上公证平台、完善电子签名制度以及建立第三方电子证据收集、认定、保全机构,尤其是建立第三方电子证据固化系统等方式完善电子证据的收集、认定与保全途径,以此保障电子商务交易过程中电子证据的真实性和合法性,使其能够在纠纷解决过程中发挥其证明案件事实的作用,有效解决纠纷,推动电子商务的进一步发展.
