论突发公共安全事件应对中的政府职责

The government lies in a leading position in the treatment of public emergencies, and is endowed with extensive power of emergency management. The authority and responsibility are unified for the government：on one hand, the government must exert its authority; on the other hand, it must follow certain legal principles during exerting its authority, or it will take the corresponding legal responsibilitiesl While Chinese government has achieved a lot in the treatment of public emergencies, some problems still exist and the efforts need to be improved. The problems are in the aspects of the coordination mechanism, the normalization of administrative enforcement measures, the compensation of administrative expropriation, the administrative sanctions, and the legal liability of administrative compensation, etc.%政府在突发公共安全事件应对中处于主导地位，被赋予广泛的应急管理权力。对于政府而言，职权与职责是统一的：一方面，政府必须行使其职权；另一方面，行使职权过程中应遵循一定的法律原则，否则就要承担相应的法律责任。我国政府在应对突发公共安全事件方面取得成就的同时，在协调机制、行政强制措施的规范、行政征用的补偿、行政处分与行政赔偿的法律责任等方面还存在着一些问题，需进一步完善。
