As the complex of modern network technology and human dynamic thinking, the applications of"human flesh search", on the one hand, promote the humanization and personalization of network, but on the other hand, usually induce large-scale and normalized cluster privacy infringement. The formation of this negative impact is partly due to the special nature of cyberspace and the fanaticism of net groups, and partly due to the incompleteness of the legal system. In response to the impact and challenges brought about by the network technology, China should make good use of the thought of "Ruling with Law" to innovate the social management system, and actively promote the improvement and refinement of the legislation, in order to realize the regulation and rational regression of "human flesh search".%作为现代网络技术与人类能动思维的综合体,"人肉搜索"的应用在促进网络人性化、个性化发展的同时,往往伴随着社会情感与理智的失衡,引发集群式隐私侵权的规模化和常态化. 这种负面影响形成的原因不仅在于网络空间的特殊性和网络群体的狂热性,还在于法律制度的不完备性. 为应对网络技术所带来的冲击和挑战,我国应善用法治的思维创新社会管理,积极推进立法的完善和精细化发展,实现"人肉搜索"的规制和理性回归.
