我国社区矫正制度的构建

摘要

目前,我国社区矫正的总体发展水平较低,表现为相关立法不够完善,社区矫正刑罚的适用率偏低,执行机制不健全等。文章对管制、缓刑、假释、监外执行、社区服务刑罪犯提出了适用社区矫正的方法,并提出社区矫正量刑改革的具体方案。%At present ,the overall community corrections in China develop at a lower level, such as relevant legisla- tion being not perfect, low rate of applicable penalties of community corrections, enforcement mechanism being not perfect, and so on. The article points out that the criminals of control, probation, parole, execution outside prison, and community service punishment are applicable to community corrections, and then proposes specific programs for sen- tencing reform of community corrections.
