刑事诉讼中非法证据排除规则的完善

摘要

我国虽已确立了非法证据排除规则，但因法律规定较宽泛，致使实务中操作时存在分歧。科学合理的非法证据排除规则既要满足打击犯罪行为的需要，又应保障人权和公民的合法权益。要建立防止非法证据产生的预防性机制，明确非法取证方式和非法证据排除的证明规则，建立非法证据排除规则的救济机制、完善对非法取证人员的惩戒制度。%Exclusion rule of illegal evidence has been established in China ,but the broader law results in difficult operation in practice .Scientific and rational exclusion rule of illegal evidence should not only meet the need to com-bat crime.but also protect the legitimate rights and interests of citizems .We should establish a preventive mecha-nism to prevent illegal evidence from coming into being ,make clear proof rules of illegal evidence collection ways and exclusion of illegal evidence ,set up relief mechanism of exclusion rule of illegal evidence ,and improve the dis-ciplinary system towards the personnel collecting evidence illegally .
