环境刑法的行政从属性

摘要

研究环境刑法的行政从属性对于实现环境刑法的有效适用、打击环境犯罪具有重要意义。对于以“空白罪状”呈现的环境刑法，在适用中主要遭遇环境行政法指引缺失以及行政瑕疵对刑事司法审查的阻挠两大问题。为解决这些问题，应利用罪名之间的交叉、包容、竞合关系，寻求新的定罪依据。同时，以法益为向导，对行政瑕疵的具体情况具体分析，以期找到一条真正解决难题的合理路径。%Environmental criminal law ,presented in “blank description of crime”,are mainly faced with the lack of guidance of environmental administrative law and administrative flaws ’ obstruction to criminal judicial review when applied .In order resolve these problems ,new basis for conviction should be sought through the cross ,inclusive ,and competing relationship among charges .Meanwhile ,we should take the legal interests as guide and analyze adminis-trative flaws based on specific cases so as to find a reasonable pathway to really solve this problem .
