供给侧结构性改革下的药品科技法律体系完善研究

摘要

Supply side structural reform contributes to the development of pharmaceutical science and technology from supply and production. To enhance competitiveness may ensure the development of pharmaceutical economy through liberating the productive forces. In the new trend of pharmaceutical transformation, with the aid of supply side structural reform, it is urgent to perfect and promote inno-vation legal system of pharmaceutical science and technology, stimulate innovation creativity, increase protection categories of indepen-dent technology drug , strengthen the protection of our drug , improve legal evading capability of patent risk , strengthen the legal pro-tection and supervision of generic drugs that will be beneficial to innovation development of pharmaceutical science and technology.%供给侧结构性改革的提出有助于促进在药品科技发展带动下的我国药品产业从供给、生产端入手，通过解放生产力，提升竞争力促进药品经济发展。在药品市场转变的新兴趋势中，借助供给侧结构性改革趋势，因势利导完善促进药品科技创新法律体系，激发我国药品科技创新活力；增加自主科技药品的保护类别，加大我国药品的保护力度；提高专利风险的合法规避能力，加强仿制药的法律保护与监管将会为我国药品科技创新力量的发展提供有利的支持。
