论自然人的物化

Along with the penetration of the science on human life,gene technology has brought the gospel to mankind,also make the scientists act as the role of god.Scientists can duplicate human cloning organs without harming human body,or even making live organ trading.But the operation of the subject as the object has a disruptive effect on pre-suppositions in civil law.People may ask： what is living organ？ The life materialized,or subject objective is defined as the opposition between man and man from one side to another.Since the ancient Roman,the theory that the thing is relative to the people that exist in all of nature things has been challenged.%随着科学对人类生活的渗透,基因技术给人类生命的优化与延续带来了福音,也使科学家扮演起上帝的角色。科学家可以用不伤害人体的方式复制器官,甚至进行活体器官交易,但这种将主体当作客体的操作对民法的前提假设具有颠覆性的影响。人们不禁要问：活体器官是为物、有体物或是有形财产、动产？人与物之间的对立,开始从另一端相对化。人们称之为生命物化,或主体客体化。自古罗马法以来＂物是相对人而存在于自然界的一切东西＂的经典论断受到了挑战。
