律师的法律监督权研究

摘要

Concept of rule of law asks to secure rights by restricting power,and realizing the good wishes of the rule of law needs the main body to supervise the exercise of power. Lawyers can take the missions of maintaining social justice, safeguarding human rights and promoting the implementation of rule of law, and be an important force to build the socialist harmonious society. Lawyers’ characteristics give themselves certain advantages in exercising legal supervision, so independent legal supervision rights should be given to lawyers, and the rule of law can be realized by perfecting lawyers’rights and building the legal supervision mechanism.%法治理念要求限制权力以保障权利，实现依法治国的美好愿望需要一定的主体对权力的行使进行监督。律师担负着维护社会正义、保障人权、促进法治实现的使命，是依法治国、构建社会主义和谐社会的重要社会力量。律师自身的特点使得其在行使法律监督权上具有一定的优势，因此可以赋予律师独立的法律监督权，并通过完善律师的权利和构建律师法律监督的机制来促进法治的实现。
