京津冀协同发展中流域生态补偿的法律制度供给

摘要

Beijing‐Tianjin‐Hebei region cooperation in the field of ecological environmental protection has become a powerful opportunity to promote the coordinated development of Beijing‐Tianjin‐Hebei region af‐ter the cooperative development of Beijing‐Tianjin‐Hebei region has become a national strategy .Because Beijing‐Tianjin‐Hebei region is facing dilemma collective action and external problems of environmental governance in watershed ecological environmental protection ,the effective way to get rid of these problems is legal system supply of watershed eco‐compensation .Legislation in advanced was proposed in the Fourth Plenary of 18th CPC National Congress ,so legislative leading role should be played in solving problems of watershed ecological environmental protection in Beijing‐Tianjin‐Hebei region .A multi‐dimensional long‐term ecological compensation legal system should be established ,and current situation of watershed eco‐compensation in Beijing‐Tianjin‐Hebei region should improved at levels of multi‐target compensation ,es‐tablishment of watershed management institutions which take charge of unified development and manage‐ment of watershed water resource and their functions ,material object combined with funds ,the ability to compensate for these aspects and compensation policies to improve the current situation of Beijing‐Tianjin‐Hebei region watershed ecological compensation ,so as to realize positive operational cooperation of water‐shed ecological environmental protection in Beijing‐Tianjin‐Hebei region .%京津冀协同发展成为国家战略后，京津冀在生态环境保护领域的合作成为强力推进京津冀协同发展的契机。京津冀在流域生态环境保护上面临着集体行动的困境和环境治理外部性的困扰，摆脱此等困扰的有效途径是生态补偿法律制度供给。依十八届四中全会坚持立法先行精神，在破解京津冀流域生态环境保护难题上，须发挥立法的引领作用。在制度设计时应建立多维长效生态补偿法律制度，从补偿的多目标性、负责流域水资源统一开发管理的流域管理机构设置及其职能、与资金补偿相结合的实物、能力及政策补偿多种补偿方式这些层面改善目前京津冀流域生态补偿现状，以期实现京津冀流域生态环境保护合作的良性运行。
