法律解释方法在“忠诚协议”案中的运用

摘要

In 2002, Shanghai Minhang People's Court made a judgment of the first domestic case of“loyalty agreement”between husband and wife. But until now the highest court still keep silent about it. With the legal interpretation method, this paper analyzes the correctness of the judgment and makes a conclusion that if the contents of the agreement do not violate the prohibitive provisions of the law, public order and customs, the no-fault party has the right to request divorce damages and the specific amount of compensation should be fully respected according to the autonomy of the parties.%2002年，上海市闵行区人民法院对国内首例夫妻“忠诚协议”案作出判决。但至今最高院仍对夫妻“忠诚协议”保持沉默。本文通过法律解释方法的运用，对判决的正确性进行评析。因“婚外情”这种违背夫妻忠实义务而订立的“忠诚协议”，只要内容不违反法律的禁止性规定和公序良俗，应当有效，无过错一方有请求离婚损害赔偿的权利，具体的赔偿数额应充分尊重当事人意思自治。
