'一带一路'投资争端调解机制研究

     

摘要

目前的国际投资争端解决机制主要是以西方国家为主导的传统投资争端解决机制,我国实施"一带一路"战略的过程中有必要探索建立适合我国海外投资特点的新机制.基于对"一带一路"沿线64个国家所涉及国际投资争端案件的实证研究,并结合我国企业与"一带一路"国家投资仲裁案件的审理情况,可以看出"一带一路"国家的投资风险较高,国际投资仲裁作为投资争端的主要解决方式存在一定缺陷.投资调解机制对于解决涉"一带一路"投资争端具有可行性和独特的优势.在投资调解机制的路径选择上,可利用目前我国与"一带一路"国家已签订BIT中的友好协商制度,或通过重新签订新型BIT方式增加投资调解条款.制度构建方面,应包括调解与其他争端解决方式的衔接、调解员选聘程序、前置调解程序和强制执行程序.%The current international investment dispute resolution mechanism is western country dominated. Dispute resolution mechanism in "One Belt One Road"construction should be based on the reality of China's overseas invest-ment, rather than simply follow the traditional way. According to empirical study of 64 "One Belt One Road"countries' investment disputes and Chinese enterprises arbitration cases with those countries, we can see the risks faced by Chinese investors and shortcomings of investment arbitration. Mediation is feasible in"One Belt One Road"investment dispute res-olution and has particular advantages. Mediation procedure could be affiliated to the BIT friendly negotiation clauses, or added to the new BIT with"One Belt One Road"countries. Mediation mechanism should include the coordinating proce-dure with arbitration and litigation, mediator-choosing, mediation procedure and enforcement.
