Public authorities have taken vigorous actions in an effort to build up a great spiritual civilization and improve social morals.They are expected to clarify the nature of administrative acts so as to ensure that their actions are legal,rational,and efficient.The reality goes too far from this expectation,however.It is a poor example that State Administration of Press,Publication,Radio,Film and Television of the PRC,issued a "blocking order" to ban notorious actors/actresses from working in this field.In the course of building a spiritual civilization,what public authorities should do are as follows: specifying the rights and subjects to be regulated,ends meeting means,and ensuring the expected legal results.Moreover,administrative laws are supposed to be modest,and social moral education can be completed by encouraging trade associations to be self-regulatory.%近年来,为加强精神文明建设和提高社会道德水准,公权力有很多作为.公权力的作为理应明晰行为的性质和确保合法合理性,以实现预设的法效果.但实际并非如此,国家新闻出版广电总局限制了劣迹演艺人员从业的"封杀令"就是反面典型.在精神文明建设中,公权力的考量进路应该是:明确自身职权和调整对象,目的和手段相适应,产生确定的法效力,同时行政法应具有谦抑性,应通过鼓励行业协会自律的方式进行道德教化.
