The establishing of an innovative country mainly depends on the indigenous innovation of the enterprises which are the principal sectors in the process and also the key parts of the project. With the technology innovation and improvement, the purpose of the innovation in one enterprise is to get the patent of intellectual property rights, which helps the enterprise get the maximum of its profit and during which enterprises may also encounter some disadvantages like the risk of researching and developing, competition from other rivals; and all these disadvantages come from the lack of regulations in the Law of Intellectual Property Right to deal with the issue of intellectual property rights abusing. This phenomenon can be attributed to the lack of regulations in the IPR and even the innovation of the enterprises itself. However, as enterprises have to conquer the issues caused by the high--tech barriers setting by developed countries and the abuse of intellectual property rights in the international trade, so in terms of practice and theory, it＇s significant to discuss their connections.%建设创新型国家，企业是自主创新的主体，企业自主创新是国家创新的核心。企业自主创新的目标是通过技术创新取得技术突破，获得知识产权，从而实现企业的最大利益。企业在追求利益最大化的过程中，面临着技术研发风险、外部竞争等不利因素，知识产权法对权力滥用的规定较少，这已成为知识产权滥用的原因，甚至企业自主创新是知识产权滥用的权利来源。而在国际经济贸易中，企业既要面对发达国家高技术壁垒，又要防止知识产权滥用。因此，研究他们之间的关系具有非常重要的现实意义及理论价值。
