我国女犯社区矫正指导原则探析

摘要

The pilot and propulsion of community corrections is a major cross-century,landmark reform of the penal system in China.However,community corrections as a new and exotic thing in the execution of punishment is undergoing the identification,recognition,adaptation and integration process in China.In the process of the pilot and propulsion of current and future community corrections,there are many issues need to study and explore.As a neglected group in the community corrections——the problems faced by female correction objects are particularly prominent in the context of the worsening female crime situation.The current correction mechanism,assessment mechanism,corrective projects are almost formulated and designed in accordance with the male correction objects,less taking into account the weak position and special needs of female prisoners in community corrections.Therefore,based on the principle of gender response,from the gender perspective,the paper explored guiding principles of community corrections for female prisoners.%社区矫正的试点和推进是我国刑罚制度的一项具有跨世纪、里程碑意义的重大改革。但是,社区矫正作为刑罚执行中的新兴事物和外来事物,正在中国经历着鉴别、认同、调适及整合的过程。在当前和今后社区矫正试点和推进的进程中,有许多问题需要研究和探讨。其中,作为社区矫正中被忽视的群体———女性矫正对象所面临的问题在当前女性犯罪形势日趋严峻的背景下显得尤为突出。现行的矫正机制、评估机制、矫正项目几乎都是依照矫正对象中的占主体地位的男犯制定和设计出来的,较少考虑到社区矫正中女犯的弱势地位和特殊需求。因此,本文以性别反应原则为基础,以社会性别观点为视角,探讨女犯社区矫正制度的指导原则。
