人身保险利益在离婚析产案件中的处理

摘要

In the judicial practice, there are different ways to deal with the personal insurance benefits in the property division of divorce cases in local courts. Most handling methods lack of legal basis for support and many other defects. The author thinks that when dealing with a divorce case,the division of personal insurance benefits should follow fair and reasonable principle, and protect legitimate rights and interests of the parties to the contract of insurance and other parties concemed.%司法实践中,有关离婚财产分割中人身保险的利益分割问题,各地方法院处理不尽相同,大多数存在缺乏法律依据支撑等诸多缺陷。作者认为在处理离婚析产案件时,人身保险利益的分割应遵循公平、合理原则,保护保险合同当事人及关系人的合法权益。
