中西法治理论起源考析

摘要

In the ancient society in the West and China,there were respectively two kinds of theory on the rule of law： ＂rule by law＂ theory of the ancient Chinese Legalist;＂rule of law better than one＂ theory of ancient Greek Athens＇ thinkers.Through the analysis of the similar two kinds of theory,we can find the difference in the content and spirit of Western and Chinese ＂rule of law＂ theory,that is why the West and China stepped on two different roads of ＂rule of law＂.The study of the difference of the theoretical origin between the West and China can provide useful reference and reflection for the contemporary construction of rule of law in China.%在中西方古代社会,分别出现了两种法治论：中国古代法家的＂以法治国＂法治论;古希腊雅典的思想家的＂法治优于一人之治＂的法治论。通过对貌似相同两种＂法治论＂的解析,可以发现中西＂法治论＂在内容和精神实质上存在着很大差异,这正是中西走上两条不同的＂法治＂之路主要原因。研究中西法治理论起源的差异,可以为当代我国法治建设提供有益的借鉴和思考。
