格式条款的立法规制简析——以中德比较法为视角

摘要

格式条款的立法规制是现代民法关注的重要问题。在大陆法系中,德国《民法典》对其的相关规定已十分完善。对比中德两国在格式条款的纳入和内容控制方面可以发现,我国立法不仅有重大的遗漏,而且有相互矛盾之处。可见,德国法对我国法有相当的借鉴意义。%Regulation about standard terms is the important problem which draws attention from modern civil law.In civil law system,the regulations in BGB are very perfect.However,compared with it,Chinese legislation is not only inclusive but also contradictory in standard terms＇ entering and controlling.This shows that the BGB has a method for reference to Chinese civil law.
