物权法新司法解释与商业银行应对之策

摘要

In order to properly hear the Property disputes, the Supreme Court on February 22, 2016 issued the"interpretation of applicable Issues (a)", since March 1, 2016 into effect. The new judicial interpretation will have a signiifcant impact on the operation of commercial banks. This paper tries to explain the main elements of the new judicial interpretation will be, and some suggestions on the policy response of commercial banks, commercial banks in order to correctly apply the new judicial interpretation will be of beneift.%为正确审理物权纠纷案件，最高人民法院于2016年2月22日发布了《关于适用〈中华人民共和国物权法〉若干问题的解释（一）》，自2016年3月1日施行。《新司法解释》将对商业银行经营产生重大影响。本文试对《新司法解释》的主要内容进行诠释，并就商业银行应对之策提出几点建议，以期对商业银行正确适用《新司法解释》能有所裨益。
