刑罚执行的目的在于预防而不在惩治，传统的监禁刑并不能适应所有的犯罪。而监禁刑的封闭性特点也容易造成服刑人员与社会脱节，出狱后难以适应社会生活。因此，对轻微犯罪行为采取监外执行的社区矫正成为刑罚执行的新趋势。社区矫正是刑罚执行改革的产物，并经过调研证明是行之有效的。但是，当前对社区矫正执行的监督还存在一些问题，如监督立法不完善、监督手段单一，监督效果不佳等问题。通过加强社区矫正的检察监督立法，建立社区矫正数据库，加大社区矫正职务犯罪防控力度等手段，可以使我国的社区矫正的检察监督体系更加完善，提升社区矫正的执行效果。%the purpose of the penalty enforcement is to prevent the crime, not to punish the criminals. The closed imprisonment is likely to cause the inmates out of touch with the society and to make them difficult to adapt to social life after their release. Thus, for minor offenses, the community corrections probation become a new trend in the execution of punishment. The community correction is a product of the reform of the punishment execution. Through researches, it is proved to be effective. However, there are still some problems, such as the inadequate legislation, poor supervision effect and other issues. By strengthening the legislation of prosecutorial supervision of community corrections and establishing a database.of community corrections, we should make greater efforts for the prevention of duty crime in community corrections. All these can make prosecutorial supervision system of the community corrections more effective, so as to enhance the implementation of the community corrections.
