罪犯再社会化过程中出监监狱（区）的矫正管理新探

摘要

在罪犯再社会化过程中,出监监狱（区）的出现突破了传统的行刑方式,重在为即将出狱的罪犯提供最大的保护,以增强其适应社会的能力,实现监狱对罪犯的人本化管理。由于此举尚在试行过程中,具体实施中仍存在一些不足。对部分犯人的调查和比较国内外矫正管理研究表明,对即将出狱犯人的矫正管理应着重从管理模式的角度加强＂管理空间＂和＂制度机制＂的建设,使罪犯在管理过程中得到矫正、调整、恢复和引导。%In the re-socialization of criminals,community correction has made a breakthrough in the traditional penalty enforcement.It focuses on providing maximum protection of those who are leaving prison in order to enhance their abilities to adapt to the society and achieve the objectives of people-oriented management of criminals.This new management is facing some problems during the execution process.Survey of some criminals and comparison of the corrective management of China with that of other countries indicate that the corrective management should focus on the construction of management space and institutional mechanism so as to correct and guide criminals.
