聚众斗殴犯罪的现实特征及其理论启示--以相关案例的实证统计分析为视角

Since affray crime set up in 1997,theoretical studies on it have been carried out deeply,but few concerns about the current situations of it.Most of them reach the corresponding results purely from theoretical perspective or based on typical case analysis.This kind of research approach without large sample statistical analysis weakens the value a case is expected to have, and leads to the studies on affray crime failing to be presented in a quantifiable,positive and verified way.Therefore,the paper analyzes 101 affray cases by using SPSS statistical software.Different from other ordinary empirical analysis,this study pays more attention to detailed analysis,and tried to study the realistic features in depth through extracting the comprehensive information of a case in order to reflect the current judicatory application and legislative regulation of affray crime.%自1997年刑法设立聚众斗殴罪后，对该罪的理论研究虽不断深入，但极少有论者关注聚众斗殴罪的现实情境，多从纯粹的理论视角或通过对数个典型案例的分析得出相应的结论，这种缺乏大样本统计分析的研究方式削弱了案例本应有的价值，也使得对聚众斗殴罪的研究不能以可量化的、确定的、有根据的方式展现出来。为此，文章使用SPSS统计软件对101个聚众斗殴案件进行了统计分析，与通常的实证分析不同，研究更关注对事实细节的把握和分析，并试图通过对案例全面信息的提取，深入研究聚众斗殴案件的现实特征，以此为视角反思当下聚众斗殴犯罪的司法适用及立法规定问题。
