对民事调解进行检察监督的法理基础探析

摘要

Some problems exposed in carrying out civil mediation system ot our country prove the importance of inspecting the mediation. But in legislation, the regulation for the procuratorate to monitor the civil lawsuit mediation activity is imperfect with the unclearness of consciousness in the legislation theory. To include the civil mediation into the scope of inspecting and monitoring is in accordance with basic spirit of Constitution and Law of Civil Lawsuit and also inevitable demands for the dual judicial structure.%我国民事调解制度在运行中所暴露的问题凸显出对其进行检察监督的重要性。然而，目前在立法上对检察机关监督民事诉讼调解活动的规定尚不够完善，立法理论上认识不清是根本原因。民事调解纳入检察监督的范围符合《宪法》和《民事诉讼法》的基本精神，也是我国二元司法体制的必然要求。
