图书馆文献传递服务中的版权结算问题研究

摘要

“复制”和“二次传播”是导致文献传递机构与版权人之间矛盾的主要原因，版权结算通过经济补偿和合理授权使用的方式可有效缓解这一矛盾。本文在概述我国文献传递服务版权处理现状的基础上，分析了发达国家文献传递服务利益格局，阐述了复制权组织的作用及版权处理实例，从版权法、复制权组织和图书馆角度提出我国文献传递服务解决版权问题的建议。%Reproduction and secondary transmission have become a conflict between the public and personal interests. The demand for copy-right clearance is keeping rising. Based on the analysis on the interest structure of document supply in developed countries, the role of RRO is articulated and some examples are given. Then this paper presents some suggestions on copyright clearance in document supply from different aspects such as copyright protection law, reproduction organizations and libraries.
