地方工业遗产保护的立法实践探析——以《黄石市工业遗产保护条例》为例

摘要

近年来,尽管国家逐步加强了对工业遗产保护和治理的相关工作,但是国家层面的工业遗产的专门法律仍然缺乏.无锡市人民政府等部门通过的《无锡建议》,拉开了中国工业遗产保护从行政管理走向法制治理的序幕,但在实践中仍存在诸多阻碍.《黄石市工业遗产保护条例》是国内首部针对工业遗产的专门法规,具有审慎严谨、注重权责、以及普适性和地方性相融等特点,在工业遗产概念的界定、注重工业遗产的保护和灵活利用及社会整体参与等方面具有创新性.该条例的出台,将会为各地今后的工业遗产立法提供垂范作用,标志着地方工业遗产保护走向了法治化的新轨道进程.%In recent years,the state strengthens the works about industrialheritageconservation and governancegradually,butindustrial heritage protection and its legislation protection at the national level is still lacking.Wuxi Charter,the declaration which isset by some administrations include the government of Wuxi,has raised the curtain what is the period from administrations to the rule of law in Chinese industrial heritage protection.Unfortunately,there are still obstacles.Regulation of the Huangshi on the industrial heritage protection,the first special law aims at industrial heritage,has scientific rigor,the clear division of power and responsibility,the mixingwithuniversality and localism,and the innovativeness in many respects like the definition of the concept,the high value for the conservation and rational exploitation.The new regulations will provide a strong demonstration effect to the other cities that have willingness to promote the industrial heritage protection and its legislation protection,and lead them to the process of the rule of law.
