Transparency emphasizes the public can know the process of power without distortion,which is a kind of responsive theory to promote democracy and optimize the structure of power.Generally speaking, the difference between transparency and disclosure embodies in value, status and principle.However, in China, transparency and disclosure seems to be accordant in substance.Seemingly, this phenomenon is due to the" error" produced by translation, but the fundamental reason is that many features of transparency are contrary to China's political and legal culture.As a result, transparency has been taken by disclosure and become a Chinese concept eventually.In the future, the value of transparency should be injected into disclosure, which is a way to reconstruct the theory of information disclosure in China and guide the practice of government infor-mation publicity.%"透明"强调公权力在运行过程中以不受扭曲的形式呈现至公共领域,本质上是一种增进民主、优化权力结构的回应性学说.从信息的权利属性出发,"透明"和"公开"的区别集中体现在价值理念、状态属性和方式原理三方面.在我国,二者在实质内容上却趋于一致.这一现象表面上缘于翻译产生的"误差",根本原因则在于"透明"的诸多特征悖反了我国的政法文化,彰显权力主导性和更具传统蕴意的"公开"因之统摄了"透明",最终将其整合成为一个"中体西用"的概念.对此,宜将"透明"的理念注入"公开",以重构我国信息公开理论,指导政府信息公开实践.
