中国传统生态法律思想及现代价值

摘要

The harmony between ancient Chinese and nature relies mainly on the laws and decrees which are deeply rooted among people. The outstanding feature of them is the seasonal protection. Moral education is the basis and punishment is the guarantee of the implementation of the laws and decrees. Although there are many ancient ecological protection systems, there are still ecological imbalances. We can cope with the ecological crisis in the process of modernization in reflecting on the gains and losses of ancient ecology and extracting experiences and drawing lessons from them.%古代中国人与自然的和谐，主要依靠深入民心的律令，它突出的特点就是时令禁护；道德教化是律令实施的基础，刑罚是律令实施的保障。虽然古代有很多生态保护制度，但也存在生态失衡问题。反思古代生态保护的得失，吸取经验和教训，以便在现代化进程中应对生态危机。
