作为一种公益行政征用，粮食应急征用的补偿标准经历了很长的历史演变过程。我国《粮食法（送审稿）》确立了对执行粮食应急征用造成损失进行补偿的合理标准，对保护相对人合法权益具有重要的意义。但是由于我国应急征用补偿标准存在模糊不清、缺乏详尽规定、补偿标准低的问题，依据我国实际情况，应借鉴其他国家经验，采取完全补偿原则、扩大补偿范围，根据受补偿粮食财产形态的规定日期确定具体的补偿金额。%As a public administrative requisition,the compensation standards of emergency food requisition have undergone a long history of evolution.China’s “Food Law (draft)”has established reasonable compen-sation standards for losses caused by implementing emergency grain requisition,which has important implica-tions for the protection of the legitimate rights and interests of people involved.However,due to the problems that the compensation standards for emergency grain requisition are vague,detailed provisions do not exist and the compensation standards are low,the experience of other countries should be used for reference according to China’s actual situation,fully compensated principles should be adopted,the scope of compensation should be expanded,and the specific amount of compensation should be determined by the stipulated date of the ac-cepted compensation property form of grain.
