民国时期国民党统治区的劳动法研究

         

摘要

民国劳动法产生后,学者们开始予以关注,并在介绍引进劳动法、评述劳动法、书写中国劳动法史及劳动法的汇编上取得了一些成绩.当时在华的外国人于劳动法研究也有贡献.1949年后,劳动法研究先是受革命史观的影响,后受现代化模式下的史学观影响.进入21世纪以后,劳动法研究逐步走向深入.但这些研究大多存在为现实政治服务、研究模式固化、研究时段集中、缺乏劳动法实施研究等现象,且史学化的研究多、法学化的研究少.今后应加强理论和方法创新,拓展研究时段,推进劳动法实施的研究.%Since the labor law of the Republic of China was enacted, a great many studies have been conducted on it from different perspectives, and a couple of achievements have been made in terms of its introduction, review, history writing and compilation in the Republic of China, to which foreigners living in China at that time made several contributions as well.After the establishment of People's Republic of China in 1949, studies on labor law was under the guidance of revolutionary history view and post-modern history view successively.In the 21st century, a series of in-depth researches have been conducted showing such characteristics as serving for politics, stereotyped research mode, focusing on a particular time, lacking studies on its implementation, and most of the studies are from the historical perspective rather than legal one.The future studies should innovate the research theory and method, expand research period and promote studies on implementation of labor law.
