论著作权法上作品的本质属性

摘要

The issue of fundamental nature of works is the question of neighboring category concept of the works .None of the intellectual achievements ,expressing modes or expression is the fundamental nature and neighboring category concept .The expressing object refers to the organic combination of symbols , the material of which is language ,words ,lines ,colors ,and the mode of which is mutual relations be-tween those symbols .The fundamental nature of works is the designed program of expressing object ,as well as the combining program of symbols .%作品本质属性问题也就是作品的相邻属概念问题。智力成果、表达方式和表达都不是作品的本质属性和相邻属概念。表达物是指符号的有序组合，其质料是语言、文字、线条、色彩等符号，其形式是符号之间的关系。作品的本质属性是表达物的设计方案，也就是符号的组合方案。
