消费者后悔权之制度成本与改进路径--以柠檬市场理论为视角

         

摘要

因买卖双方的信息不对称导致网络欺诈频发,电子商务市场存在柠檬化。后悔权是立法者对消费者进行权利倾斜性配置,以保护消费者的正当利益,但在实施过程中,后悔权在抑制消费者的道德风险,保护小额交易,减低经营者的逆向选择等方面发挥的作用有限。为此,利用治理柠檬市场的理论,增设有理由浮动期限机制和第三方介入等制度对后悔权进行改善,并鼓励建立商盟制度,同时完善相应责任机制。%Because of information asymmetry between sellers and buyers,network fraud happens fre-quently,leading e-commerce market to a lemon market.The right to regret that lawmakers endow consum-ers is to protect their legitimate interests.But in the implementation of the right to regret,its role is limit-ed in suppressing consumers’moral hazard,protecting small transactions and reducing the adverse selection of operators.For this reason,using the theory of governing lemon market,administrations could create the floating time mechanism and third-party intervention to improve the system of the right to regret,and en-courage operators to build the consortium,and at the same time,perfect the responsibility mechanism.
