我国立法采用"机构标准"划分仲裁裁决国籍,与《纽约公约》的"地域标准"不一致,导致实践中国际仲裁机构在内地作出的裁决面临承认与执行的困境.《纽约公约》项下的非内国裁决是对"地域标准"的补充.在"一带一路"背景下我国宜采取更为开放的态度,不以互惠保留限制非内国裁决适用公约.国际上认定仲裁裁决国籍的主流标准是"地域标准",实践中,我国自2009年呈现出向"地域标准"转变的趋势.随着"一带一路"和自由贸易区建设的推进,国际仲裁机构在内地作出的裁决将越来越多.短期而言,内地法院宜将此类裁决认定为非内国裁决,适用《纽约公约》;长期来看,我国立法应采用"地域标准",将带有涉外因素的该类裁决认定为我国的涉外仲裁裁决,依我国法律进行审查和监督.%China's law adopts the"institution criterion" to identify the nationality of an arbitral award, which is inconsistent with the "territory criteri-on" provided in the New York Convention , and brings about the dilemma to the recognition and enforcement of arbitral award made by a foreign arbi-tration institution in Mainland China .The non-domestic award under the New York Convention is a supplement to the "territory criterion".And un-der the"Belt and Road" Initiative, in respect of the relationship between the reciprocity reservation and the non -domestic award, we'd better adopt a more open approach that reciprocity reservation does not limit the application of the Convention to the non -domestic award.Internationally, the pre-vailing criterion to identify the nationality of an arbitral award is "territory criterion".In practice, China has shown a trend towards "territory criteri-on" from 2009.With the implement of the "Belt and Road" initiative and the construction of China (Shanghai) Pilot Free Trade Zone, more and more foreign arbitral awards will be made by foreign arbitration institutions in Mainland China .In the short term, China' s court should identify such awards as non-domestic awards, and apply the New York Convention to them for the recognition and enforcement thereof;in the long run, China's relevant law should be amended and adopt the "territory criterion", and such awards with foreign factors shall be identified as the foreign -related arbitral a-wards of China, which shall be reviewed and supervised in accordance with the relevant laws of China.
