乡村政府治理国家法实效研究

摘要

Village governance is a fundamental system design of rural governance under the national law. However, researches show that such a pattern of governance is likely to fail due to the dissimilative phenomenon of grass-root administrative power and vallagers' indifference to their rights. In order to improve the situation, priority should be given to raise villagers' autono-mous right consciousness and cure the dissimilation of grass-root administrative power.%乡村政府治理是国家法关于乡村治理的基本制度设计,然而实证研究的结论是,这一国家法规则在实践中趋于失效,基层行政权力异化现象严重,村民对于自己的权利主张漠然.克服这种国家法失效的状况,除了提升村民的自主权利意识外,重要的是如何限制基层行政权力的异化问题.
