方言的法律应用和法律方言学

摘要

A dialect, as an important daily communication tool for the masses, is also widely used in the judicial field. Dialect can reflect the speaker's identity and regional information, helps to identity the suspect in the process of case investigation, and sometimes plays the role of encrypting the transmitted information. In the process of authenticating language materials, the knowledge about dialect is conducive to solving some disputes and misunderstandings in language communication and coming up with convictive conclusions. The concept of "forensic dialectology" was introduced from foreign countries, initially referring to applying the knowledge about historical dialectology to linguistic evidence in court. Since its introduction into China, the scope of forensic dialectology has expanded and shown its significant role in the domain of forensic linguistics.%方言是广大民众重要的日常交际工具,在司法领域有着广泛的应用.方言反映说话人的身份、地域信息,能够在案件侦破过程中辅助确定案件嫌疑人,有时还能起到加密传递信息的作用.在语言材料的鉴定过程中,方言知识能够有效地解决语言交流中的一些纠纷和误解,产生有说服力的结论.法律方言学的概念产生自国外,最初指将历史方言学知识应用于法庭语言证据的分析,该学科引入我国后范围有所扩大,在我国法律语言学学科中有着重要的地位和作用.
