家务劳动经济补偿与夫妻财产制的关系——从家务劳动的评价基准入手

摘要

家务劳动经济补偿制度与夫妻财产制度之间的关系一直是我国学界关注的问题,但学者观点莫衷一是。笔者从家务劳动的评价基准着手,考察家务劳动经济补偿制度的源头后发现家务劳动经济补偿与夫妻财产制之间的关系并不确定,也无须确定。在适用我国婚姻法第40条时,宜区分夫妻双方是约定分别财产制还是所得共同制,但是这种区分只是在适用经济补偿制度确定补偿数额时的考量因素。%Domestic scholars pay much attention to the relevance of compensation for homework on divorce and matrimonial regime, but their points of view are different and contradictory. This paper investigates the origin of compensation for homework on divorce in terms of the appraisal datum of homework, and discovers that there is no certain relevance between the two and it is no need to conform. In applying Article 40 Marriage Law, we should tell separate jurisdiction and community property apart, but it is just effect factor of the economic compensation amount.
