中国知识产权文化的基础、价值和愿景

摘要

Attitudes to knowledge and knowledge creation have been existent long before the appearance of the concept of intellectualproperty rights .The ancient Chinese literary ethics and the western universal value can be considered the cultural foundation for intellectual property legislation .The core values of intellectual proper‐ty culture lie in respect for knowledge ,promotion of innovation ,honesty and integrity ,and property rights protection .And the prospects for intellectual property cultural development are the combined and complemen‐tary advancement of intellectual property culture and intellectual property legislature .Therefore ,intellectual property culture should be advanced ,with the emphasis on developing property rights values so as to promote intellectual property institutional culture and intellectual property spiritual culture ,w hich plays a leading role in the development and implement of intellectual property legislature .%在产权观念诞生之前，对待知识和知识生产的态度就古已有之。中国古代的文德意识和西方的普世精神堪称知识产权立法的文化基础。知识产权文化的核心价值，是尊重知识、崇尚创新、诚信守法、保护产权。知识产权文化发展的愿景是知识产权文化与知识产权互相促进、协同辉煌。因此，应当以知识产权文化为纽带、以知识产权价值观培育为重点，促进知识产权从制度文化到精神文化都走向成熟，同时，彰显知识产权文化在知识产权勃兴和治理过程中的精神引领和促进魅力。
