人工智能时代的法律因应

摘要

人工智能时代的来临引发一系列新的伦理与法律问题,亟需前瞻预判、审慎决策,及时应对其所伴生的风险与挑战.当下应当对人工智能的发展和应用施加必要的伦理约束与法律规制,注意弱智能向强智能演化给现有法律关系带来的影响,重视无人驾驶汽车、服务机器人等人工智能产品造成损害之际产品责任及责任保险从消费者向生产者的重心转移,健全和改进人工智能监管方式,防范自主武器系统的反人道法倾向.%The advent of the age of artificial intelligence causes a series of new ethical and legal issues,so fore-sight and prudent decision-making are needed to respond to the associated risks and challenges.We should ex-ert necessary ethical constraints and legal regulations on the development and application of artificial intelli-gence,and pay attention to the impact of artificial intelligence on existing legal relationships as it goes from weak to strong.In particular,more attention should be given to the transfer of product responsibility and lia-bility insurance from the consumer to the producer w hen unmanned vehicles,service robots and other artificial intelligence products cause damages.We also should improve artificial intelligence supervision mechanism,and prevent the anti-humanistic tendencies of the killer robot.
