“渝富桥”商标异议案中五个程序的认定结果依次相反，这反映了《商标法》（2013）修改前近似商标注册审查实务中存在着严重的分歧。这种分歧源于原来的《商标法》对近似商标界定不明确，实践中对近似商标的内涵及其与准予注册之间的逻辑关系认识不一致。以体系解释的方法来理解《商标法》（2013）第30条，近似商标申请注册审查标准是一个多层级递进式的逻辑结构：第一步，对申请注册商标构成近似商标的层进式审查：一是审查申请注册商标与引证商标的标志是否构成近似；二是审查申请注册商标是否完全具备商品关联性、空间和时间重合性三要件；三是判定申请注册商标是否属于近似商标。第二步，对属于近似商标的申请注册商标，进一步作是否符合注册标准的层进式审查：一是审查申请注册商标是否容易导致与引证商标的混淆；二是审查有无阻却违法的事由；三是商标局决定是否准予初步审定公告或注册。%The different results of five procedures of “Yu Fu Qiao”trademark opposition case reflect the serious differ-ences in the practice of Registration and Examination of similar trademark before the modification of the Trademark Law (2013).This divergence comes from the different understanding of logical relation between the similar trademark and the approval of registration.The meaning of the article 30 of the trademark law (2013)with the system interpretation method is:the registration and examination standard of similar trademark is a multi and progressive logical structure.The first step,the progressive examination for whether the trademark applying for the registration constitutes the similar trade-mark:first,whether the disputed trademark and the cited trademark are similar;second,whether the disputed trademark constitutes a similar trademark with the requirement of the association and the coincidence of space and time;third, whether the trademark applying for the registration constitutes the similar trademark.The second step,the progressive ex-amination for whether the trademark applying for the registration conforms to the registration standard:first,whether the disputed trademark easily leads to the confusion of the cited trademark;second,whether the disputed trademark is ille-gal;third,whether the Trademark Office decides to approve the registration.
