FIDIC施工合同条件下变更与索赔的比较研究

摘要

Variations and claims are often appear in the international engineering as well as the emphases and difficulties in contract management of domestic and foreign engineering,which easily cause confusions to us.To systematically study the relation between them,this paper analyzes their differences and relation on definition,scope,character,cause,principles of treatment,valuation and payment,processing program.So the both concerned sides should distinguish them and grasp the relation in contract management.%变更和索赔是国际工程中经常出现的现象,也是国内外工程合同管理的重点和难点,处理上容易造成混淆.通过分析FIDIC施工合同条件下变更与索赔在定义、范围、性质、原因、处理原则、计价支付、处理程序上的区别以及两者的联系,系统研究了两者的关系,提出承发包双方在合同处理上既要区别又要善于把握联系.
