检法分歧现象的审视与思考

摘要

It is an objective phenomenon that procuratorates and courts should arrive at different conclusions. We can find out problems and explore regular patterns by observing the phenomenon. Based on a sample investigation, this article fully reveals the phenomenon in judicial practice, aiming to see the whole picture from the sample. The article makes a deep analysis of the causes, trying to explore regular pattems. Based on the analysis, the article gives rational reflections and comes up with some countermeasures.%检法分歧是司法实践中的客观现象，观察这一现象可以发现问题、探寻规律。本文以实证考察为出发点，以点代面，全面展示了司法实践中的这一现象，深入剖析其中的原因，探寻规律，并在此基础上进行了理性反思和对策研究。
