哺乳期未哺乳妇女之逮捕必要性探析--以简某某贩卖毒品案为例

孩子出生之后主动放弃，涉嫌犯罪之后再次想起，身处哺乳期却未哺乳的女性嫌疑人，是否有逮捕必要，是在审查逮捕中遇到的一个新问题。本文以一个贩毒案为例，通过对羁押必要性的深入分析，指出在回归逮捕理念、重塑审查模式、保护特殊哺育妇女的基础上，将“婴儿利益最大化”作为衡量哺乳期未哺乳妇女之逮捕必要性的根本标准。%The necessity of arresting the female suspect who’s in lactating period but not lactating, or once gave up the baby voluntarily after birth and recalled the baby after being a suspect, is a new question in arrest reviewing. This paper takes a drug trafifcking case as an example, analyzes the necessity of detention thoroughly, points out the idea of returning basic arrest principle, remodeling the viewing pattern and protecting the pregnant female. Finally, this paper emphasizes that the Maximization of Baby Interest is the fundamental principle in deciding the arrest necessity to the female suspect who’s in lactating period but not lactating.
